Case Study †Sources of International Law, ‘Non-binding’ agreements & Treaties

Abstract International agreements are frequently entered into by sovereign States and international organisations. Whilst many of them are formal treaties and thus have binding effect, others do not fit into this category and thereby remain non-binding agreements. This often leads to a great deal of dispute resolution procedures taking place since it is generally quite difficult to determine whether an agreement is binding or not. Using Iran as a case study, an agreement that has recently been entered into will be reviewed in order to determine its legal effects and consequences. Introduction A Treaty is a written agreement that has been entered into by international law actors, such as international organisations and sovereign States. A Treaty is thus a type of contract that allows parties to voluntary enter into the agreement in order to be bound by its terms (Fitzmaurice and Elias, 2005: 10). Accordingly, treaties are â€Å"the only way States can create international law consciously† (Dixon, 2007: 26) and may either be bilateral or multilateral. The legal status of the agreement between Germany and the five permanent members of the Security Council (SC) and Iran will be reviewed in order to consider its legal status, whether it is binding and whether it will prevail over previously SC resolutions. The equality of States doctrine will also be considered in order to establish whether it is workable in practice. The legal status of this agreement. Is this a TreatyWhy? The ‘Treaty of Non-Proliferation of Nuclear Weapons’ is a multilateral Treaty that opened for signatory at London, Moscow and Washington on the 1st July 1968 and entered into force on the 5th March 1970. The TTreaty currently has 190 State Parties, 93 signatories and 4 Depositary Governments(UN, 1968: 1). Under this Treaty Iran has been able to develop a nuclear programme that has been regarded suspicious by many other countries (Kerr, 2013: 2). Despite this Iran has persistently claimed that the peaceful nature of its activities aimed to develop nuclear energy. Consequently, Iran has thus entered into an agreement with the Security Council and Germany in order to put an end to all sanctions being inflicted upon them. Whether this will arouse further suspicion is arguably, yet the agreement, also known as the ‘Joint Action Plan’, is also a ‘Treaty’ in that it imposes obligations upon the State parties; Case Concerning the Gabcikovo-Nagymaros Pro ject (Hungary v Slovakia) (1998) 37 ILM 162. Furthermore, because this is a legally binding agreement between the State parties that has been created by two or more subjects of international law, it can be recognised as having Treaty status. Under the 1969 Vienna Convention on the Law of Treaties all States have the capacity to make treaties. This can be made available to the SC under Article 43 (3) of the UN Charter. Again, this further indicates how this agreement is capable of being a Treaty (Hollis, 2012: 75). Nevertheless, the parties to the agreement must intend for it to be binding at international law (Villiger, 1985: 35). This does appear to be the case given that the agreement contains a unilateral Statement because as was confirmed by the International Court of Justice (ICJ) in Australia v France, New Zealand v France 1974 ICJ Rep 253; unilateral statements of States are legally binding in appropriate circumstances. The legal status of this agreement is that it is therefore a Treaty and legally binding. As such, Iran will no longer be sanctioned for developing a nuclear programme, which they claim to be for peaceful purposes. Are Resolutions of the SC sources of International Law/Binding? Resolutions of the SC generally have binding effect; Legal Consequences for States of the Continued Presence of South Africa in Namibia (South West Africa) notwithstanding SC Resolution 276 (1970) Advisory Opinion of 21 June 1971, although there has been some focus by the ICJ on their other effects, such as authorising effect and (dis)empowering effect (Basak, 1969: 385). The effect of the resolution will, nonetheless, depend entirely on its type . This is because a SC resolution may either be a recommendation or a decision, which are not clearly defined in the Charter. As a result, it is often difficult to determine the legal effects of such resolutions (Johnson, 1955: 107), however the Court generally refers to binding resolutions as decisions and non-binding resolutions as recommendations; Certain Expenses of the United Nations (Article 17, Paragraph 2 of the Charter) [1962] ICJ Rep 151, at 163. SC resolutions resolution are binding if they create obligations on its recipients and if they are made under Chapter VII (Action with Respect to Threats to the Peace, Breaches of the Peace and Acts of Agression). Since the ‘Joint Action Plan’ agreement imposes obligations on its State parties and contains a threat to the peace, it is likely that this will again render it a binding resolution. However, it has been pointed out by Hollis that the agreement is not binding on the basis that it â€Å"implies something aspirational rather than required.†(Hollis, 2013: 1). This is evident from the wording; â€Å"The goal for these negotiations is to reach a mutually-agreed long-term comprehensive solution that would ensure Iran’s nuclear programme will be exclusively peaceful (Geneva, 2014: 1). Therefore, whilst it seems that the agreement is a legally binding resolution, the fact that only recommendations are being made may suggest that it is not and sceptics ha ve argued that the plan is â€Å"just a false front for the Iranians in order to have sanctions lifted† (Midwest Diplomacy, 2013: 1). Therefore, although SC sources of international law are binding, it has been questioned whether Iran should be provided with the ability to develop their nuclear programme even further as this could have disastrous effects (Zand, 2014: 1). In case of conflict between this agreement and previous SC Resolutions which one should prevail? The determination as to whether SC decisions possess an overriding binding effect will be determined on a case by case basis. However, it is usually the case that SC recommendations will not have an overriding binding effect; Questions of Interpretation and Application of the 1971 Montreal Convention Arising from the Aeriel Incident at Lockerbie (Libya v UK) Preliminary Objection [1998] ICJ Rep 9, at 26, whilst SC decisions will; Reparation for Injuries Suffered in the Service of the United Nations [1949] ICJ Rep 174. Therefore, if the ‘Joint Action Plan’ is merely a recommendation then this will not be binding and will therefore not prevail over previous SC Resolutions. If the agreement is a decision, however, then it will be prevail as it will have a binding effect. In Lockbie, Provisional Measures [1992] ICJ Rep 3 it was held by the ICJ that pre-empting obligations that flow from traditional sources of international law can be overridden by the normative powers of th e SC in order to ensure that peace and security is maintained, yet the binding effect of resolutions will depend on their language, the discussions leading up to it and the provisions of the Charter being invoked (Oberg, 2005: 879). In Application for Review of Judgment no. 273 of the United Nations Administrative Tribunal (‘Mortished affair’) [1982] ICJ Rep 325 Resolution 34/165 reversed the prior decision in Resolution 33/119 in order to avoid two incompatible legal effects co-existing. Therefore, because SC Resolutions 1696 (2006) of 21 July 2006 and 1737 (2006) of 26 December 2006 will be incompatible with the new agreement, they may be reversed if the new agreement has an overriding binding effect. This is highly beneficial for Iran since they deemed the previous resolutions unfair on the basis that they had received different treatment to other States. Comment on the parties of this agreement. What does it say about the equality of States in practice? The doctrine of equality of States covers both legal equality and political equality. Legal equality deals with the legal relations that exist between States, whilst political equality deals with the distribution of economic and military power between States. Because Iran appears to have been given exceptional powers under the new agreement, it is likely that these new powers will be considered contrary to this principle. This is because Iran is effectively being given additional powers to control its nuclear program and is also being protected from any sanctions imposed by other States. As the doctrine seeks to ensure that all States are treated equally under international law, States ought to have the same rights and responsibilities as each other (Kelsen, 1952: 156). As this is not being effectuated under this agreement, it is clear that this principle is being contravened. Nevertheless, there is an exception to the doctrine in cases where there has been a ‘breach of the p eace’ or an ‘act of aggression’ that threatened international peace and security. Therefore, because Iran has stated that they aimed to develop nuclear energy for peaceful purposes, the violation of this doctrine will be permitted (Nahar, 2005: 1). This agreement thereby illustrates that the equality of States doctrine may not actually be workable in practice since the doctrine may be contravened if the aim is to maintain international peace and security. Conclusion Overall, it appears as though Iran’s agreement with the SC and Germany is a Treaty and will therefore have binding effect. This is because the agreement has been made purely to maintain peace and security. Although Iran’s activities have been met with some suspicion over the years, they have continued to state that the peaceful nature of their activities merely aimed to develop nuclear energy. As this agreement does appear to be a Treaty, it is likely that it will be capable of prevailing over previous SC resolutions. This is welcoming for Iran who were subjected to unfairness as a result of resolutions 1696 and 1737, although not all would agree with this decision. Hence, many would argued that the agreement conflicts with the equality of States doctrine. Nevertheless, because Iran have stated that they are acting in the interests of national security, the doctrine will be capable of being breached. Accordingly, the Doctrine is therefore not always workable and in thi s instance, Iran are being treated more favourably than other States. References Basak, A. The purported changes include reducing emphasis on vocabulary, making the essay optional, changing from a 2400 scale to 1600, and eliminating the guessing penalty, and more. New Scoring System or Old Scoring System? One of the major changes is a shift from 2400 points to 1600 total. Seems like a drastic change? Well, the 1600 system used to be the old system until year 2005. This isn't so much a "new change" insomuch as it's a reversion to the old way of doing things. And eliminating a pure writing section to be reading and math again? We saw that before 2005 too! This isn't a surprise to SAT experts. Many colleges have been reluctant to accept the 2400 system. Most colleges downweight the writing section, and some colleges throw away the writing score altogether. The College Board has learned their lesson that cramming a writing score down the mouths of students and colleges isn't the way to go. A turn to the 1600 system isn't so much a major step forward as much a reversion to older times and older strategies. 2. No Guessing Penalty? That makes no difference! The SAT makers announced today that the guessing penalty will be eliminated from the SAT. It turns out that mathematically this makes no real difference on the way you take the test. This isn't mere speculation, but a proven Statistics 101 fact. The intuition behind the proof is that even now there is no real guessing penalty to begin with: even in the current SAT, there is no expected statistical loss if you make a completely random guess! We'll post more about the proof later, and what you can do to take advantage of the new system, but take our words on it there's no change at all to meaningful guessing tactic. 3. Less Vocabulary? This has been the trend already. Did you hear that the new SAT won't be chock full of rare words (esoteric, inscruable, recondite, etc)? While this gives academics a topic to argue about (how important are difficult words in assessing education), it doesn't mean that much for the student. This has been the way the SAT has been trending for years. In fact, most of the power of vocabulary for the SAT was neutralized when the SAT decided to get rid of analogies in 2005. Before 2005, analogies and vocabulary used to dominate the SAT and form the large majority of skill tested in the reading section. The reduction of vocab on the SAT is more symbolic than practical. Practically speaking, rare words have been on the decline for years. And don't pack up your index cards yet: the SAT will still target vocab to some extent, but more towards words that are used in college courses like "synthesis and "empirical". 4. Optional Essay? Optional if you don't want to impress colleges. Supposedly the new essays are going to be optional. Some people have even called this "dropping the essay from the SAT." This is far from true if the past is any indicator. In reality, the colleges that students apply to will decide what's optional and what's not. What's technically optional optional paper may not be optional in reality. For example, back in 2005, not only were essays optional, the entire writing section was optional! You know what happened? A large number of universities requested the writing section anyway. In the end, all students had to take the "optional" writing section in order to have a shot at these universities. Sure, so go ahead and make the essay optional. But until colleges stop requesting them, new students will still do well by studying for an essay. 5. Real Changes? Look at history. This isn't the first time the makers of the SAT said they were going revolutionize the SAT. Did you know major changes were announced in 2005, 1994, and regularly before that even? Graphic design Essay I have been surrounded with art my whole life. My aunt is a photography major and my father started out in graphic design but now does more of the business side than creative. I grew up in a home that had a love for art. When I was little I used to sit for hours and hours and watch my dad work on his projects. I just loved watching how he created the beautiful picture and wanted to learn how I could do it too. I took art classes in elementary and junior high school and loved being able to create pictures with pencil, oil pastels, paint, or create a vase with broken pieces of glass. Once I got to high school I took digital photography, drawing, web design, and interior design and loved it all. I knew graphic design was what I wanted to do when I looked at all the classes required for the major and couldn’t wait to take all of them and learn all that I could. The beauty of art has always attracted me and I have always loved being able to create it myself. Sometimes I kind of struggle with the whole inspiration or â€Å"what do I draw† thoughts, but with graphic design there is more of a need where a client needs a logo, or a web page, or play bill to be designed. There is already the need and I am here to fulfill that need with my creative ideas and it has more of a purpose than to just make somebody feel something. It is to catch the viewers’ eye and intrigue them to come to your event or buy your product. I love being able to help people. The Fundamental Arguments Of Nature Versus Nurture Philosophy Essay Nature is generally considered the part of a person that is a genetic inheritance, the fundamental identity that determines the choices someone will make. Nurture is the environmental factor to someones development: his or her socioeconomic standing, privileges, disadvantages, opportunity, access, etc. The blank slate, or tabula rasa, theory presented by John Locke during the 17th century states that everyone is born with nothing and is shaped by his or her environment; in other words, Lockes theory supports the nurture side of the nature versus nurture debate. On the other hand, ones genetic disposition to intelligence determines how one will interact with the environment. These two sides propose that they each hold the ultimate verdict to a persons personality and all of the psychological aspects that go along with it. Of course, both the idea of nature and the idea of nurture contribute to the human psyche but they do so at varying degrees in each individual: that is to say, one m ay feel the effects of nature more persistently than the effects of nurture and vice versa. Because of the inconsistent nature of clinical psychology, there is no absolute value for ones percentage of influence being that of nature or nurture but there are instances in which there is no denying that each theory plays a role in human development. A study of leadership suggested that varying degrees of socioeconomic status, perceived parental support, and perceived conflict support determined how much genetic or environmental influence affected someones leadership position; these findings are consistent with the conceptual argument proposing that the presence of adversity and conflict allows for a greater influence of genetic differences in capabilities related to leadership (Zhang et al.). That is to say, depending on the environmental stresses involved, the genetic aspect of the debate took more or less control. A study dealing with low-income mothers perception of their childrens obesity revealed that most of the mothers believed that because of their childrens genetic heritage, no matter what diet, the children could not lose weight; on the other hand, the mothers, with equal force, blamed themselves and/ or other environmental factors on their childrens weight problems (Hughes et al.). Despite the fact that the mothers fi rst argument logically disproves their second argument, the mothers have a vested interest in both aspects of the nature versus nurture debate. They are very unsure as to what degree they have made mistakes and to what degree genetics has influenced their childrens weights. The science is not all there but, for now, it is safe to assume that both sides of the debate carry different percentages of the weight. We all know of cases of people brought up in horrendous circumstances who somehow transcend these to display compassion and tendernessà ¢Ã¢â€š ¬Ã‚ ¦ Conversely, people brought up in seemingly balanced households may be capable of the most horrific crimes (Gaba). Without delving too deeply into clinical psychology, Gaba has made a sizable case for the nature aspect of the debate. Oprah Winfrey stands to be a great example of the rags to riches fable. She was not only a poor, black Mississippian but she had also been sexually abused in addition to getting into trouble as a teen (Walker). Oprah is now one of the most prominent figures in todays society, easily reaching the millions, if not billions, with her successful television and business career. In his autobiography, Stephen Fry describes his stealing compulsion despite coming from an upper-middle class family. At boarding school he would take money from other students even though his parents set up a deal with a local shop owner where Stephen could take as much money as he liked (Fry). His environment provided him with non-thieved money yet Frys nature caused him to develop kleptomania. Psychological studies veer off into the impact of environment. The increasing recognition of genetic propensity to mental health disorder suggests that the advent of genetic therapies in the not-too-distant future may eventually provide alternative biological means of treatment (McVicar, Clancy). In other words, because mental health is a part of the nature piece of the debate, the drugs used to facilitate the mental illness are the environmental aspect. In this case, nurture controls nature. The relationship between an individual and his or her environment is a cause towards that persons mental stability and there are many instances of environmental influences on physical as well as psychological health (McVicar, Clancy). On the other hand, some environments bring forth mental instability for some people. Homelessness tends to wreak havoc on the mind and may bring about a psychological disorder that could have been at bay under a different environment. Mental illness is a source of complication for the nature versus nurture debate because certain peoples genetic dispositions will cause them to develop psychological disorders no matter what the circumstance while others experience trauma which causes them to develop mental disorders while still others inherit genetics that will see them through any difficult episode. There was a study that addressed the environmental and genetic impacts on alcohol, cannabis, and nicotine dependency: the control was Vietnam-era twins from the United States and the researchers concluded that alcohol and nicotine dependency were based primarily on genetic factors but that cannabis dependency was a mixture of genetic and environmental influence (Xian et al.) The contributors of this study fully recognized that their findings do not cross over to different cultures or different time periods within the history of the United States. They do, however, mention that they had a large sample that was pretty much consistent throughout their observations. This simply shows that human science and understanding of the mind is so very complex that it will take an indefinite amount of time to fully understand the human condition on a scientific level. On the issue of drug abuse, the government likes to bombard the television with antidrug campaigns that endorse the environmental influence as the main perpetrator in the case of evil drug use. Conversely, alcohol advertisements are out there on full display, usually showing that drinking is a very natural state of socialization. The study of nicotine, alcohol, and cannabis dependency would support alcohol and discourage the use of drugs. If drugs are an environmental cause, they can therefore be more easily combated because ones environment is more easily controlled than ones genetic inheritance. If drinking and smoking, i.e. nicotine use, are genetically controlled, they are much more difficult to wane out of society. Those in favor of the legalization of marijuana, or, at the very least, comedians, like to argue that drug use is generally less harmful to other people because alcohol is major factor of death by car. Both alcohol and drug abuse are harmful to the individual, most ca n agree to that, but if drug abuse is, indeed, less harmful to the outside world, alcohol is the more harmful of the two substances. Here is the problem with the nature versus nurture debate: if humans are genetically predisposed to like alcohol but they are environmentally enticed to take pleasure in drugs, which is the lesser of two evils? Nature cannot be controlled; people are stuck with the hereditary cards they have been dealt. On the same note, nurture is around at all times, it will have an influence no matter what the case. People who are introverts will stay introverts if they keep to their cabins millions of miles away from human contact. If some introverts are introduced into society at as quiet intellectuals, some will choose to stay, some will choose to go. There are two different paths and which path one will take is dependent on ones emotions which are directly connected to genetics. This argument likes to runs circles around itself until there is no telling which wa y is up. Environment pressure cannot be overlooked simply because genetic bias is the basic groundwork for ones behavior. Environmental experiences come into contact with, and influence individualsà ¢Ã¢â€š ¬Ã‚ ¦ some individuals may possess genetic risk and protective factors that exacerbate, or partially insulate them from, the effect of negative environmental experiences (Petrill). The key word here is experience. At the first touch of experience, ones genetic impulses take control. Babies do not automatically latch on to their mothers breast for milk but through genetic imperative and experience do they become more accustomed to their environment and learn different techniques by which they may derive their food. Some would argue that music is a genetic inheritance but because of time and effort involved in mastering scales, finger patterns, rhythmic beats, and all of the other skills required to be a master of music, the environmental concept of experience definitely outweighs the geneti c basis for music inheritance. It takes roughly 10,000 hours, or 10 years, to truly be an expert in any given field (Gladwell). Wisdom is the fundamental basis for knowledge. Young people who endlessly fill their heads with historical, scientific, philosophical, theological, and other types of knowledge do not have the experience to back up their findings whereas the older someone ages, the more likelihood there is that his or her wisdom will be deemed more valid simply because he or she possesses more experience. Masters teach pupils for a reason; there will be a day when the student usurps the master but that is because the student has enough experience to do so. Reinforcement theory is the process of shaping behavior by controlling the consequences of the behavior (Cengage). Instead of using physical punishment as a form of reinforcement, parents will try to encourage their children to stop throwing large jars of liquid pickles at the local grocery store in return for an ice cream sandwich. The child is genetically predisposed to throwing a temper tantrum, looks around his environment, sees jars of pickles, and throws them to the ground screaming in sordid agony about not being able to finish watching his favorite television show three times over that day. The mother then introduces another environmental factor, in this case the ice cream bar, to stop the effects of the double-teaming of the effects of nature and nurture. She is unable to control his demented wailing and so chooses to try even further reinforcement therapy by offering a life-time supply of ice cream for the next seven days. He accepts because now the environmental stimulus h e is now receiving is stronger than his genetic malfunction earlier that minute. This just goes to show that for each individual, that nature versus nurture debate is extraordinarily inconsistent within the span of a human life but also inconsistent within just a few seconds. There is no scientific way to determine how much influence nature or nurture has within one human mind but there is evidence to suggest that both exist in their metamorphic forms.

Warren Earl Burger was born September 17th, 1907 in St. Paul, Minnesota. He was of Swiss and German ancestry and served as the 15th Chief Justice to the United States Supreme Court. The ending scene for both Journey’s End and Black Adder Goes Forth are similar and different in many ways. For example, the last episode of Black Adder Goes Forth greatly affects the viewer by pursuing the idea that history as it was written and has been taught is incorrectly. In having this approach, it is like the audience is rediscovering history and uncovering the truth of our ancestors for the first time. Not only does this capture the viewer’s attention, but it entertains them as well as touching them on an emotional and comedic level by showing the real life orders trench’s but deliberately miss hearing what the orders were. Viewers, however, also know that these orders are not to be taken seriously and are only there for the comedy value. An example of this is when one soldier states that the reason for the war was because someone shot an ostrich out of hunger. The majority of viewers know this is not true, but the episode and character plays the comic seriousness to perfection. However, Journey’s End shows the more serious side of the war and trench life by being a serious side of the war and trench life by being a serious play with no real comedic value. This is much like Raleigh in Journey’s End when he first enters the battalion and his innocence is intact because he does not know the true horrors of war yet. Act three scene three of Journey’s End is the very last scene of the play. From almost the very beginning we have known that an attack from the German opposition is inevitable. However, the character in the play are not sure when it will take place or what form it will take place in, as the attack could happen in any moment meaning the ension is high throughout and especially in the final scene. This is not the only tension in the script. At the beginning of act three scene three, Raleigh and Stanhope, two of the most prominent characters, have had a large argument about the death of a mutual friend, which is not resolved until the beginning of the final scene. The strain on their relationship has been tense for the duration of the play and was heightened by the hero worshipping Raleigh did for Stanhope. As they were previously well acquainted before they were both in the battalion Stanhope fears that Raleigh would look at him badly and tell people on the home front what he has become, an alcoholic, and Stanhope chooses to ignore their previous relationship and address him as a new Officer. This contrasts with Blackadder Goes Forth, because as Colonel Melchett knows George he uses this to his advantage by manipulating him into showing propaganda to the men; however Colonel Melchett also has an underlying theme of worry for George and seems to offer him many ways out of fighting the war because he knows his death is inevitable. To conclude I feel that Blackadder Goes Forth and Journey’s End and two completely different plays. However, they both share few similar themes, for example they both share the theme of hero worship, where soldiers look o authority figures for guidance which again opposes the view that Sassoon has on the war. They also share the theme of waiting, because both plays are waiting to ‘go over the top’ and neither plays want to because they know that your death was sure if you do so due to the heavy equipment the Germans have. Although, I believe Journey’s End is much more a serious play whereas Blackadder Goes Forth uses comedy and takes from the impact it could truly have if it was more realistic to trench life, but it still shows the fear and anger of many men when regarding the war.

They have realized that customers are also trying to eat a little healthier and they have developed new technology to grill the chicken instead of frying it but always keeping the quality high. KFC have done budgeting which is the most important mechanism for financial control. It was the glory of Indian democracy that an educationist aloof from politics but with an international acclaim as a profound scholar was placed in the position of the President. And it was an advantage for a young country like India to have him to interpret its domestic and foreign policies abroad to expound its outlook and aspirations emphatically and in the rightway which was much needed in a world of uncertainity and disbelief among nations. His appointment as President was hailed by Bertrand Russel who said It is an honour to philosophy that Dr. Radhakrishnan should be President of India and I, as a philosopher, take special pleasure in this. Plato aspired for philosophers to become kings and it is a tribute to India that she should make a philosopher her President. History reserved for Radhakrishnans term of office as President much suspense and surprise. Within months of his ascendancy in 1962 there was the Chinese invasion. The nations morale was dealt a blow but RadhakrishnanOs voice, firm and resolute came on the air to reassure a shaken nation: Owing to the difficult terrain and numerical superiority of the Chinese, we suffered military reverses. These have opened our eyes to the realities of the situation. We are now aware of our inadequacies and are alive to the needs of the present and the demands of the future. The country has developed a new purpose, a new will. In 1965, Pakistan violated our Western frontiers. Dr Radhakrishnan in his broadcast to the nation on September 25, 965 said,Pakistan assumed that India was too weak or too afraid or too proud to fight. India, though naturally disinclined to take to arms felt the necessity to defend herself when attacked. Pakistan also assumed that communal disturbances would occur in the country and in the resulting chaos she could have her way. Her miscalculations must have come to her as a rude shock. Dr. Radhakrishnan had great faith in Indian democracy. In his farewell broadcast to the Nation on May 12, 1967, he said that despite occasional forebodings to the contrary, the Indian Constitution had worked successfully so far. But democracy, he warned, was more than a system of the Government. It was a way of life and a regime of civilised conduct of human affairs. We should be the architects of peaceful changes and the advocates of radical reform, he said. It was in 1962 when Dr. Radhakrishnan became the President of India that his birthday in September came to be observed as Teachers Day. It was a tribute to Dr. Radhakrishnans close association with the cause of teachers. Whatever position he held whether as President or Vice President or even as Ambassador, Dr. Radhakrishnan essentially remained a teacher all his life. The teaching profession was his first love and those who studied under him still remember with gratitude his great qualities as a teacher. Pandit Jawaharlal Nehru, who was one of his closest friends throughout, said about Dr. Radhakrishnan: He has served his country in many capacities. But above all, he is a great Teacher from whom all of us have learnt much and will continue to learn. That in itself shows the kind of men we honour and respect. Bharat Ratna, the highest award of the nation, was conferred on him in 1954 in recognition of his meritorious service to mankind.
